After observing a vehicle driving the wrong way on the round about, a Campus Safety officer stopped David Lee Rushbrook and assisted the Prescott Police Department in arresting him driving with a blood alcohol content of 0.144.
The Campus Safety officer observed the vehicle traveling at inconsistent speeds and drove quickly through the parking lot of one of the residence halls. Upon exiting the parking lot, the vehicle turned left where a right turn only is permitted and drove across a dirt median to get into the correct lane. It then pulled into another parking lot and parked in a parking space.
The officer then contacted Rushbrook and smelled the odor of alcohol.
"Rushbrook could not keep his balance and staggered when he walked," according to the information the Campus Safety officer provided in a Prescott Police Department report.
An officer from the Prescott Police Department was called to the scene and the Campus Safety officer remained with Rushbrook.
When the Prescott officer contacted Rushbrook, he noted in the report, "I noticed a strong odor of an alcoholic beverage coming from him and noticed that he swayed moderately."
The officer then administered field sobriety testing on Rushbrook. During the tests, Rushbrook performed poorly and blew a 0.144 during a Portable Breathalyzer Test.
After being arrested and en route to the police station, Rushbrook urinated on himself and the back seat of the police car.
During processing, an Intoxilyzer test was administered and gave a reading of 0.151 nearly an hour and a half after the officer's initial contact with him.
Rushbrook's license was then suspended for 90 days and released into the custody of a friend.
According to public record, in 2004, Rushbrook was charged with possession of marijuana and false reporting to law enforcement in Prescott Valley. The court dismissed the marijuana possession charge.
